“Copyright infringement is the act of exercising, without permission or legal authority, one or more of the exclusive rights granted to the 版权 owner under section 106 of the Copyright Act” (Title 17 of the United States Code). These rights include the right to reproduce or distribute a 版权ed work. In the file-sharing context, downloading or uploading substantial parts of a 版权ed work without authority constitutes an infringement. Penalties for 版权 infringement include civil and criminal penalties. 在一般情况下, anyone found liable for civil 版权 infringement may be ordered to pay either actual damages or “statutory” damages affixed at not less than $750 and not more than $30,000 per work infringed. For “willful” infringement, a court may award up to $150,000 per work infringed. A court can, in its discretion, also assess costs and attorneys’ fees. Technical College of the Lowcountry has designated an agent to receive notification of claimed 版权 infringement on TCL’s web site as required by the Digital Millennium Copyright Act. If you believe your work is being infringed on TCL’s web site, please notify our 版权 agent.

According to the Digital Millennium Copyright Act, the notification of claimed infringement must include:

  • Identification of the 版权ed work claimed to have been infringed (include ISBN, title, etc.)
  • Identification and URL of the material that is claimed to be infringing
  • Information sufficient to contact the complaining party, 比如地址, 电话号码, 传真号码, and electronic mail address
  • Other information relating to your claim
